Terms of Service

Introduction
Welcome to VideoPitcher. These Terms of Service ("Terms") govern your access to and use of the VideoPitcher website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
1. Acceptance of Terms
By registering for or using the Service, you represent that you have the authority to enter into these Terms on behalf of yourself or an organization. You must be at least 18 years old to use the Service unless otherwise permitted by local law.
2. Services Provided
VideoPitcher provides a secure platform for employers to create video-based interview links containing text and video questions, and for candidates to submit text answers and recorded video responses. Employers receive candidate submissions through VideoPitcher for review and hiring-related decisions.
3. Account Registration and Security
- Users must provide accurate, current, and complete information when registering.
- You are responsible for maintaining the confidentiality of your account credentials and any activity that occurs under your account.
- Notify us immediately of any unauthorized use or security breach.
4. User Conduct
Users agree not to:
- Use the Service for unlawful purposes or in violation of any applicable laws.
- Upload content that is defamatory, obscene, infringing, or otherwise unlawful.
- Attempt to gain unauthorized access to the Service or interfere with its operations.
5. Content Ownership and License
Users retain ownership of the content they upload (e.g., candidate videos, text responses). By uploading content to VideoPitcher, you grant VideoPitcher a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and transmit the content solely to provide the Service, including sharing candidate submissions with the employer who requested them.
6. Candidate Video Submissions
VideoPitcher stores and transmits candidate video submissions to the employer specified in the interview link. Employers are responsible for reviewing and using candidate submissions in compliance with local employment laws and anti-discrimination rules. Candidates should only submit content they are authorized to share and must not include sensitive third-party information unless they have consent.
7. Paid Services and Billing (if applicable)
Certain features of VideoPitcher may be offered on a subscription or paid basis. Payment terms, billing cycles, and refund policies will be described during purchase. All fees are non-refundable except as required by law or as expressly set out in a written agreement.
8. Privacy and Security
Your privacy is important. Our Privacy Policy explains what personal data we collect and how we use it. By using the Service you consent to our collection and use of information as described there.
9. Disclaimers
The Service is provided "as-is" and "as available" without warranties of any kind. VideoPitcher does not guarantee hiring outcomes, accuracy of user-provided information, or uninterrupted availability.
10. Limitation of Liability
To the maximum extent permitted by law, VideoPitcher and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our aggregate liability for direct damages will be limited to amounts you have paid to VideoPitcher in the 12 months preceding the claim, or USD 100 if you have not paid fees.
11. Indemnification
You agree to defend, indemnify, and hold harmless VideoPitcher and its officers, directors, employees, and agents from claims, damages, liabilities, and expenses arising out of your breach of these Terms or your violation of any law or the rights of a third party.
12. Termination
We may suspend or terminate your access for violations of these Terms or other policies. Upon termination, you remain responsible for any outstanding fees and for any content you uploaded.
13. Changes to These Terms
We may modify these Terms from time to time. When we do, we will post the updated Terms with a revised effective date. Continued use after notice constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the jurisdiction where VideoPitcher is incorporated (or specify the governing jurisdiction). Disputes will be resolved in the competent courts within that jurisdiction.
